1. Introduction
Welcome to Ridelink. These Terms of Service ("Terms") govern your access to and use of the Ridelink platform, including our mobile applications, website (ridelinktt.com), and related services (collectively, the "Services").
Ridelink is operated by RSA DIGITAL LTD, a company registered in Trinidad and Tobago ("Company," "we," "our," or "us"). The Services provide a technology platform that connects passengers with independent drivers for ride-hailing and transportation services within Trinidad & Tobago.
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our Services.
2. Eligibility and Account Registration
2.1 Age Requirement
You must be at least 18 years of age to use our Services. By using Ridelink, you represent and warrant that you meet this age requirement.
2.2 Account Types
Ridelink offers two types of user accounts:
- Passenger Account: For users who wish to request and book rides
- Driver Account: For users who wish to provide transportation services to passengers
Users may maintain both account types but must complete separate verification processes for each.
2.3 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.
3. Verification Requirements
3.1 Passenger Verification
All passengers must complete identity verification by providing:
- Valid government-issued identification (National ID, Driver's License, or Passport)
- Selfie photograph for identity verification
- Additional documentation as may be required by our verification team
3.2 Driver Verification
Drivers must meet additional requirements and provide the following documentation:
- Valid Trinidad & Tobago Driver's Permit (Class 3 or above)
- Valid government-issued identification
- Vehicle registration document (vehicle must be manufactured 2014 or later)
- Valid vehicle insurance policy covering commercial use
- Selfie photograph for identity verification
- Vehicle photographs (interior, exterior, and license plate)
- Successful completion of background checks and verification interview
3.3 Ongoing Verification
We reserve the right to re-verify user information at any time. Documents and certifications must be renewed annually or as they expire. Failure to maintain valid verification status may result in account suspension or termination.
4. Driver-Specific Terms
4.1 Independent Contractor Status
Drivers are independent contractors, not employees, agents, or partners of RSA DIGITAL LTD. Drivers have full discretion to accept or decline ride requests and to determine their own schedule and work hours.
4.2 Commission Structure
Ridelink charges drivers a 20% commission on the total fare for each completed ride. The remaining 80% of the fare is retained by the driver. Commissions are calculated and deducted automatically from each ride payment.
4.3 Vehicle Requirements
Driver vehicles must meet the following standards:
- Manufactured in 2014 or later
- Valid inspection certificate
- Clean interior and exterior in good working condition
- Valid commercial insurance coverage
- Proper registration and licensing as required by Trinidad & Tobago law
4.4 Driver Conduct and Responsibilities
Drivers agree to:
- Operate vehicles safely and in compliance with all traffic laws
- Maintain valid insurance, registration, and licensing at all times
- Provide professional and courteous service to passengers
- Keep vehicle information current in the Ridelink platform
- Not discriminate against passengers on any prohibited basis
- Accept payment only through the Ridelink platform
5. Ride Booking and Payments
5.1 Fare Calculation
Ride fares are calculated based on distance, time, ride type, and demand. Passengers are shown the estimated fare before confirming their ride request. Final fares may vary based on actual route and time.
5.2 Payment Methods
Ridelink accepts the following payment methods: cash and card payments. All in-app payments are processed securely through third-party payment processors.
5.3 Cancellations
Both passengers and drivers may cancel ride requests. Cancellation fees may apply depending on the timing and circumstances of the cancellation. Excessive cancellations may result in account restrictions.
5.4 Ride Credits and Referrals
Ridelink may offer ride credits, promotional discounts, and referral bonuses. These are subject to specific terms and conditions and may be modified or discontinued at any time. Credits are non-transferable and have no cash value.
5.5 Disputes and Refunds
Fare disputes must be submitted through the app within 48 hours of ride completion. We will investigate all disputes and issue refunds at our sole discretion where appropriate.
6. User Conduct and Prohibited Activities
Users must not:
- Engage in fraudulent, illegal, or harmful activities
- Harass, threaten, or abuse other users or staff
- Provide false or misleading information
- Attempt to manipulate ratings, pricing, or matching systems
- Use the Services for unauthorized commercial purposes
- Violate any applicable laws or regulations
- Interfere with the proper functioning of the Services
- Access or use another user's account without permission
7. Ratings and Reviews
Both passengers and drivers can rate each other after completing a ride. Ratings help maintain service quality and community standards. Users with consistently low ratings may have their accounts suspended or terminated.
Ratings and reviews must be honest and based on actual experiences. Users must not manipulate the rating system or submit fraudulent reviews.
8. Safety and Emergency Features
8.1 Emergency SOS
The Ridelink app includes an emergency SOS button that allows users to quickly alert emergency contacts and local authorities. By using this feature, you consent to the sharing of your location and trip information with emergency services.
8.2 Trip Sharing
Users can share real-time trip information with trusted contacts. Shared information includes live location, driver details, and estimated arrival time.
8.3 Incident Reporting
Users must report any safety incidents, accidents, or misconduct immediately through the app. We take all reports seriously and will investigate accordingly.
9. Liability and Disclaimers
9.1 Platform Provider
RSA DIGITAL LTD provides a technology platform that connects passengers with independent drivers. We do not provide transportation services. All transportation services are provided by independent third-party drivers.
9.2 No Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
9.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RSA DIGITAL LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:
- Your use or inability to use the Services
- Any conduct or content of third parties on the Services
- Unauthorized access, use, or alteration of your content
- Accidents, injuries, property damage, or other incidents occurring during rides
- Actions or omissions of drivers or passengers
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO RIDELINK IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED TRINIDAD AND TOBAGO DOLLARS (TTD $100), WHICHEVER IS GREATER.
9.4 Driver Responsibility
Drivers are solely responsible for their vehicles, insurance, licensing, and compliance with all applicable laws. Drivers are responsible for any damage, injury, or loss arising from their provision of transportation services.
10. Indemnification
You agree to indemnify, defend, and hold harmless RSA DIGITAL LTD, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:
- Your use of the Services
- Your violation of these Terms
- Your violation of any rights of another party
- Your provision or use of transportation services
- Any negligent or wrongful conduct on your part
11. Dispute Resolution and Governing Law
11.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of Trinidad and Tobago, without regard to its conflict of law provisions.
11.2 Jurisdiction
You agree that any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Trinidad and Tobago.
11.3 Informal Resolution
Before filing any formal claim, you agree to first contact us at support@ridelinktt.com to attempt to resolve the dispute informally.
12. Termination
We may suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to:
- Violation of these Terms
- Fraudulent or illegal activity
- Consistently poor ratings or reviews
- Failure to maintain required verification status
- Risk to safety or security of users or the platform
You may terminate your account at any time by contacting support. Upon termination, your right to use the Services will immediately cease.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the app. Your continued use of the Services after such changes constitutes acceptance of the modified Terms.
14. General Provisions
14.1 Entire Agreement
These Terms constitute the entire agreement between you and RSA DIGITAL LTD regarding the Services and supersede all prior agreements.
14.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
14.3 Waiver
No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.
14.4 Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
